Cancelling a Transaction

A transition becomes liable to duty on entering into it, conditional or not. Whilst the parties may choose to cancel a transaction. A refund or cancellation of the liability to duty can only be achieved if section 107 of the WA Duties Act applies ( there are exceptions, for example there could not have been an agreement or transaction in the first instance).
